With one kind of EB-5 visa in limbo, another takes its lead role

After the Employment-Based Fifth Preference Category (EB-5) Regional Center Program lapsed in Congress in late June, the EB-5 Direct Program has become popular with a growing surge of foreign immigration applicants who are investing in businesses here.
The US EB-5 visa, employment-based fifth preference category, or EB-5 Immigrant Investor Visa Program, was created by the Immigration Act of 1990, which provides a method for eligible immigrant investors to become lawful permanent residents by investing substantial capital to finance a business in the US that will employ at least 10 American workers.
